These terms and conditions (Terms) are entered into between SOG (insert relevant identification details) (we, our, or us) and you, the person using our website or mobile application available on the Apple App Store and Google Play Store (App).
We may make changes to these Terms at any time. If we do, we will let you know by sending you a written notice or by notifying you on our Platform. If you continue to use our Platform after we have notified you of any changes, this will be taken as your acceptance of the amended terms. If you do not agree with the changes, please stop using our Platform and delete your account.
Through our App, we provide a platform (our Platform) allowing you to compare items (Items) from various stores.
We facilitate the Platform (The SOG Services), not providing shopping or delivery services. Shoppers are third-party contractors, not our employees. We disclaim liability for Shopper services, Items from stores, or any contracts between you and them.
By using our services, you:
- warrant review of these Terms;
- warrant reading our Privacy Policy (available on our Platform);
- (If you are under 18 years old), you must obtain permission from a parent or legal guardian to access and use the Platform. By accepting these Terms, you represent that you have obtained such permission; and
- agree to use our Platform and accept our Services following these Terms.
If you are a parent or legal guardian allowing a minor to access the Platform, you agree to:
- please ensure that the minor's usage of the platform is monitored and supervised,
- assuming all risks and liabilities resulting from the minor's use of the Platform.
- ensure content on the Platform is suitable for the minor,
- ensure the information submitted by the minor is accurate, and
- provide the consents, representations, and warranties contained in these Terms on the minor’s behalf.
We may suspend your Account or terminate these Terms immediately:
- if you engage in conduct breaching clause;
- for a breach not remedied within 5 business days of notice;
- for reasons compromising our ability to provide Services; or
- if ceasing The SOG Services with a 30-day notice.
Upon expiry or termination of these Terms:
- cease using our Platform;
- we immediately cease providing The SOG Services;
- agree payments made are non-refundable.
Do not use our Platform to compete with or damage our business.
You are responsible for your use of our Platform.
Granting you a non-exclusive, royalty-free, revocable, worldwide, non-transferable license to use our Platform, all other uses are prohibited without our written consent.
When using our Platform and The SOG Services:
- Do not engage in offensive or inappropriate conduct;
- Do not breach an individual’s privacy or any legal rights;
- Do not defame, harass, threaten, menace or offend any person;
- Do not interfere with any user of our Platform;
- Do not tamper with or modify our Platform, transmit viruses, or damage/interfere with it;
- Do not use our Platform to send unsolicited electronic messages;
- Do not facilitate or assist a third party in prohibited acts;
- Do not download information or images unless specified as downloadable on our Platform.
Our Platform is designed for personal use, not commercial.
We may (at our discretion) terminate your Account and/or these Terms for conduct prohibited by these Terms.
Create an account (Account) to access Platform features.
To create an Account, provide accurate and up-to-date personal information. All provided information is treated per our Privacy Policy.
Register using your Social Media Account, authorizing access to certain information.
Provide accurate information during registration and regularly update it. Account details are personal; do not transfer without our written permission. Keep account details confidential; you are liable for all activity.
We may contact you via the Platform or off-platform channels.
Terminate your Account using the ‘Cancel Account’ functionality.
Place orders for Items through the Platform. We'll notify order acceptance and payment validation via text message.
We may reject an order at our discretion, notifying you of rejection.
Each accepted Order forms a binding agreement between you and the Shopper.
Check Order details before submission.
Some Items may not be suitable for certain circumstances; check suitability before ordering. We are not responsible for determining suitability.
Certain products (Restricted Products) may be age-restricted. By purchasing these,
you confirm age eligibility. Shoppers may request identification for age verification.
If age verification fails, the Shopper won't deliver Restricted Products.
Prices for Items are as shown on the Platform. Incorrect pricing may occur, and we
reserve the right to correct errors.
Prices are inclusive of applicable taxes.
Promotions are subject to availability and may be withdrawn at our discretion.
Our Platform, content, and associated intellectual property are owned or licensed by
us. Do not use, copy, or reproduce without permission.
User-generated content grants us a worldwide, royalty-free, irrevocable license.
Report infringement of intellectual property.
Refer to our Privacy Policy for information on data collection, use, and protection.
Consent to your data being used per the Privacy Policy.
We may contact you with promotional offers. Opt-out options are available.
We provide the Platform “as is” without warranties. We disclaim all liability.
You indemnify us against claims arising from your use of the Platform.
Our liability is limited as per applicable laws.
Terminate these Terms by ceasing use of the Platform and notifying us.
We may terminate these Terms immediately for breach or at our discretion.
Post-termination, obligations, and liabilities continue.
